From Texhoma, Terrance drove his victim to Dumas, Texas, and then to his house in Canyon, Texas. We don’t know what happened at the Terrance McGuire home. One can only imagine.

On January 19th, 2007, this ogre who preys on our nation’s youth, drove the child to Clovis New Mexico. He stopped at a convenience store and finally freed her from the nightmare she had been facing. She ran to the clerks in the store and the police were notified.

Likely, Terrance figured he was getting away with his ugly acts by driving the girl so far. It didn’t work. A tip to Texas County Sheriff Rick Caddell gave law enforcement what they needed. In June 2009, McGuire was identified as the perpetrator of the kidnapping. There was no struggle when McGuire was arrested on August 7, 2009, in Canyon, Texas. The FBI along with the Canyon Police made the collar.

Justice was swift. On September 15, 2009, McGuire pled guilty to one count of kidnapping and transporting the victim across state lines. If he had his way with the helpless child he got away with it. But he will have more than 41 years to think about what he did. He will probably have less than that. Many child molesters don’t make it long in the Penn. They are not popular with the inmate population.

"You would think that in a little community like this that our daughter would be safe," Christopher Graham, the victim's father said after her disappearance.

“The protection of our children is, and will remain, a top priority of the United States Attorney's Office and the Department of Justice as a whole," said U.S. Attorney Sanford C. Coats. "These tragic and complicated cases require the cooperative effort of federal, state and local law enforcement. That was certainly true with this case.”

Judge Vicky Miles-LaGrange

Chief United States District Judge Vicki Miles-LaGrange pronounced the sentence. McGuire will have five years of supervised release if he gets out of prison before he goes to boot hill. He will, of course, have to register as a sex offender. There is also a $7,335.70 sum due the State of Oklahoma for victim assistance.

The Terrance Lynn McGuire case stands for three propositions: If you go after our children we will track you down and we will find you; We will punish you to the fullest extent of the law; if you kill our children we will put you on death row, leaving you in a desperate solitude which is worse than death itself. McGuire did one thing right.

Technorati Tags: terrancy lynn mcguire,vicki miles-lagrange,child predator,transporting a child across state lines,sheriff caddell,sex offender,registered sex offender
Unknownnoreply@blogger.com0tag:blogger.com,1999:blog-6136519541714533128.post-32597126919486625382010-03-24T08:29:00.000-07:002010-03-24T11:12:55.557-07:00Trucker indicted for abduction, planed to marry 11 year old Amber alert pays off!
Amber alert saves child,

After awhile, the stories about child abductions start to have a familiar ring. One ring tone we hear over and over is about the cat who picks up an under age child and takes her across state lines with the intention of sexual gratification. This case rings true to the theme, except the under-aged youth being transported across state lines was an 11 year old, not the traditional 14 or 15 year old. If allegations are true, Elmer Zelaya-Robles from Dallas Texas, will be bending over for a brute in the big house for a long time. Child molestors don't do well when caged with violent criminals.

A frantic call came over the switchboard at 2:30 p.m. on February 13th, 2010. The father of an 11 year old Karina Manzana-Garcia, who lives in the 400 block of 69th Place in Seat Pleasant, Maryland, called to report that his daughter was missing, indicated Cpl. Larry Johnson, a Prince George's police spokesman.

"Signs along the interstate system were activated"

An amber alert was issued reporting the child missing and providing information to media for public distribution. The report allowed regular television and radio programming to be interrupted for the announcement. Signs along the interstate system were activated. Of course, law enforcement nation-wide was notified.

One possibility was the child left with Elmer Zelaya-Robles, a family acquaintance who parked his 18 wheeler near the family home. It had been there the night before. Police were advised to be on the look-out for an orange tractor trailer.

We don’t know if a passing motorist noticed the truck and called. However, around 10:00 p.m. that night a Tennessee State Trooper found the driver of an 18 wheeler with an orange cab pulling into Love’s Truck Stop, in Jackson, Mississippi. The driver was identified as Elmer Zelaya-Robles. As the officer was in the process of questioning the driver the Amber Alert came over his radio. Elmer Fudd got the silver bracelets. Lost inside the truck’s sleeper was an 11 year Karina Manzana-Garcia.

"According to reports, he had convinced

her the two should be married"

According to reports, Elmer had wooed little karina. He had convinced her the two should be married. They had some long talks about what Elmer wanted in a wife-someone to take care of him even if she had to take care of children at the same time.

While the child’s life was saved, karina’s innocence had already been robbed, alleged by reports in the Washington Examiner. The 11 year old tike told child services Elmer had done the dirty with her three times. Two boxes of condoms were reportedly found within the sleeper. Condoms usually come in boxes of threes and boxes of 12's. These were probably the three to a box assortment which explains why threre would be two boxes.

Zelaya-Robles faces a mandatory minimum sentence of 10 years in prison if convicted. Additional charges may be pending.

Every man has the right to be presumed innocent unless and until judged guilty in a court of law. The charges by the Grand Jury don't match the charges alleged by some of the reports. The reports I used for this blog were all over the map regarding various details of this abduction. Some said the child was returned un-harmed, while other said she was violated. For example, a report in Websleuths.com indicated the Karina's middle name was Elizabeth, based upon a Washington Post article.

If found guilty then Zelaya has a tough time in front of him, as he should. If he is innocent of the crime let's hope that is determined quickly, as well.

My message to men who keep singing the same tune: If you mess with our children we will catch you and you will pay a high price! Think about what you are doing before you make a mistake of a life time. If you are having trouble, get help now! They won't do much for you if you wait and end up in prision, except mark your grave.

The indictment was announced by United States Attorney for the District of Maryland Rod J. Rosenstein, Special Agent in Charge Richard A. McFeely of the Federal Bureau of Investigation; and Chief Roberto L. Hylton of the Prince George’s County Police Department.

"This case demonstrates the heroic ability of law enforcement to make the difference"

“Nationwide law enforcement coordination, modern technology and a shared commitment to pursue criminals who prey on children contributed to the quick arrest of Mr. Zelaya and the recovery of the child,” said U.S. Attorney Rod J. Rosenstein. “Local, state and federal law enforcement quickly coordinated their efforts and within hours after issuing an AMBER alert, the missing girl was found in Tennessee. This case demonstrates both the terrible danger that sexual predators pose to children and the heroic ability of law enforcement to make a difference.”

This case was brought as part of Project Safe Childhood, led by United States Attorneys’ Offices and the Criminal Division's Child Exploitation and Obscenity Section (CEOS). Details about Maryland’s program are available at http://www.usdoj.gov/usao/md/Safe-Childhood/index.html.

The United States Attorney Rod J. Rosenstein thanked the Tennessee Highway Patrol for their assistance in the investigation and commended Assistant U.S. Attorney Stacy Dawson Belf, who is prosecuting the case.

Dave Gibson from the conservative Denver rag, the Examiner, tries to turn this into an illegal alien problem starting with his title "Amber Alert saves 11-year-old girl abducted by Salvadoran national" As it turns out Elmer Zelaya-Robles was allegedly heading for his homeland, El Salvador, when he got stopped. However, he was not an illegal alien. He is here under full documentation. Any monster can abduct a little child. Putting it onto the backs of Latinos or undocumented persons is inane.

Not everyone can take advantage of the Amber Alert, a tragedy in this country. Those who live in Sheriff "Little Joe" Arpaio's Maricopa County, in Arizona, would have to think twice about calling for an Amber Alert should one of their children be abducted. That is, if mother, father or the child were undocumented. Based upon the raids "Little Joe" ordered this weekend, the immigrant community has been terrorized and can't approach local law enforcement for help. Imagine, losing your daughter and being so afraid of law enforcement you can't ask for a simple Amber Alert!

One day perhaps the leaders of this country will put a stop to abusive police tactics by rogue law enforcement. Until then, all we can do is trust ethical law enforcement agencies like the State Patrol in Tennessee who rescued 11 year old Karina, as well as the FBI and law enforcement all over the country who work so hard to get it right.
Unknownnoreply@blogger.com0tag:blogger.com,1999:blog-6136519541714533128.post-88199963730061871672010-03-07T13:33:00.000-08:002010-03-07T14:03:29.621-08:00LMSD fights back! Therefore, all drug traffickers are terrorist and subject to the almost non-existent court over-sight of law enforcement activity. You can read the Patriot Act in it's full glory here. It is technical in nature as are most laws but a great challenge for a student heading to law school!

There are few situations in which an ordinary citizen will not fall under the act. One of them is eating Mike and Ikes candy.

While the school board might make an argument they suspected a student of narcotics trafficking, searching for a lost notebook won't cut the mustard. If they subsequently find a person involved in narcotics traffiicking, the original search was illegal, hence under the Fruit of the Poisonous Tree Doctrine in Constitutional law. The law says in so many words,

"fruit of the poisonous tree" doctrine is an offspring of the Exclusionary Rule. The exclusionary rule mandates that evidence obtained from an unreasonable search, must be excluded from trial. Under the fruit of the poisonous tree doctrine, evidence is also excluded from trial if it was gained through evidence uncovered in an unreasonable search. The fruit of the poisonous tree doctrine was established primarily to deter law enforcement from violating rights against unreasonable searches and seizures."

Note, the law may not prohibit the collection of data through unreasonable searches. It precludes use of the information in the prosecution of the case. Therefore, when Vice Principal Lyn Matsko confronted 15 year old Blake Robbins for what she thought was illegal narcotics use she broke the law in the prosecution portion of the 'Fruit of the Poisonous Tree' Doctine. There mere collection of the evidence is subject to question.

The biggest problem with the Pennsylvania computer spy cam case is the violation of the reasonable expectation of privacy. According to the itlaw wickja:

"To establish a reasonable expectation of privacy a person must establish two things:

1. That the individual had a subjective expectation of privacy;

2. That subjective expectation of privacy is one that society is prepared to recognize as reasonable.

If either element is missing, no protected interest is established (according to Katz v. the United States)."

The privacy of one's own home is a place in which "society is 'prepared to recognize as legitimate'". As a result, it didn't matter what Blake was doing, masturbating, making love, in the bathroom or only dining on Mike and Ikes candy. The expectation of privacy is paramount in one's own home.

If the government, in this case the Lower Merion School District, had informed students of the ability to spy on them using a computer lap top, there might be grounds to consider such spying. Take a look at United States v. Unfortunately the same advances in computer and telecommunication technology that allow our children to reach out to new sources of knowledge and cultural experiences are also leaving them vulnerable to exploitation and harm by computer-sex offenders.

Highlights

1. Your child spends a lot of time on the net, especially at night. Most children who fall prey to computer-sex-offenders spend a large amount of time on the net. Parents are advised to monitor such use.

2. Children on-line are at the greatest risk during the evening hours. Most offenders work so they, too, are on line during evening hours.

3. You find pornography on your child's computer. Sex offenders often supply their potential victims with pornography as a means of opening sexual discussions and for seduction.

Child pornography may be used to show the child sex between children and adults is "normal."

4. Look for thumb drives and other internet storage media which is guarded by your child. It may be an indication he is harboring pornographic images he does not want the rest of the family to see.

5. Be alert if your young one is getting telephone calls by older men whom you do not know.

Introduction

While on-line computer exploration opens a world of possibilities for children, expanding their horizons and exposing them to different cultures and ways of life, they can be exposed to dangers as they hit the road exploring the information highway. There are individuals who attempt to sexually exploit children through the use of on-line services and the Internet. Some of these individuals gradually seduce their targets through the use of attention, affection, kindness, and even gifts. These individuals are often willing to devote considerable amounts of time, money, and energy in this process. They listen to and empathize with the problems of children. They will be aware of the latest music, hobbies, and interests of children. These individuals attempt to gradually lower children's inhibitions by slowly introducing sexual context and content into their conversations.

"Computer-sex offender can be any age or any sex the person does not have to fit the caricature of a dirty, unkempt, older man"

There are other individuals, however, who immediately engage in sexually explicit conversation with children. Some offenders primarily collect and trade child-pornographic images, while others seek face-to-face meetings with children via on-line contacts. It is important for parents to understand that children can be indirectly victimized through conversation, i.e. "chat," as well as the transfer of sexually explicit information and material. Computer-sex offenders may also be evaluating children they come in contact with on-line for future face-to-face contact and direct victimization. Parents and children should remember that a computer-sex offender can be any age or sex the person does not have to fit the caricature of a dirty, unkempt, older man wearing a raincoat to be someone who could harm a child.

Children, especially adolescents, are sometimes interested in and curious about sexuality and sexually explicit material. They may be moving away from the total control of parents and seeking to establish new relationships outside their family. Because they may be curious, children/adolescents sometimes use their on-line access to actively seek out such materials and individuals. Sex offenders targeting children will use and exploit these characteristics and needs. Some adolescent children may also be attracted to and lured by on-line offenders closer to their age who, although not technically child molesters, may be dangerous. Nevertheless, they have been seduced and manipulated by a clever offender and do not fully understand or recognize the potential danger of these contacts.

This guide was prepared from actual investigations involving child victims, as well as investigations where law enforcement officers posed as children. Further information on protecting your child on-line may be found in the National Center for Missing and Exploited Children's Child Safety on the Information Highway and Teen Safety on the Information Highway pamphlets.

What Are Signs That Your Child Might Be At Risk On-line?

Your child spends large amounts of time on-line, especially at night.

Most children that fall victim to computer-sex offenders spend large amounts of time on-line, particularly in chat rooms. They may go on-line after dinner and on the weekends. They may be latchkey kids whose parents have told them to stay at home after school. They go on-line to chat with friends, make new friends, pass time, and sometimes look for sexually explicit information. While much of the knowledge and experience gained may be valuable, parents should consider monitoring the amount of time spent on-line.

Children on-line are at the greatest risk during the evening hours. While offenders are on-line around the clock, most work during the day and spend their evenings on-line trying to locate and lure children or seeking pornography.

You find pornography on your child's computer.

Pornography is often used in the sexual victimization of children. Sex offenders often supply their potential victims with pornography as a means of opening sexual discussions and for seduction. Child pornography may be used to show the child victim that sex between children and adults is "normal." Parents should be conscious of the fact that a child may hide the pornographic files on diskettes from them. This may be especially true if the computer is used by other family members.

Your child receives phone calls from men you don't know or is making calls, sometimes long distance, to numbers you don't recognize.

While talking to a child victim on-line is a thrill for a computer-sex offender, it can be very cumbersome. Most want to talk to the children on the telephone. They often engage in "phone sex" with the children and often seek to set up an actual meeting for real sex.

While a child may be hesitant to give out his/her home phone number, the computer-sex offenders will give out theirs. With Caller ID, they can readily find out the child's phone number. Some computer-sex offenders have even obtained toll-free 800 numbers, so that their potential victims can call them without their parents finding out. Others will tell the child to call collect. Both of these methods result in the computer-sex offender being able to find out the child's phone number.

Your child receives mail, gifts, or packages from someone you don't know.

As part of the seduction process, it is common for offenders to send letters, photographs, and all manner of gifts to their potential victims. Computer-sex offenders have even sent plane tickets in order for the child to travel across the country to meet them.

Your child turns the computer monitor off or quickly changes the screen on the monitor when you come into the room.

A child looking at pornographic images or having sexually explicit conversations does not want you to see it on the screen.

Your child becomes withdrawn from the family.

Computer-sex offenders will work very hard at driving a wedge between a child and their family or at exploiting their relationship. They will accentuate any minor problems at home that the child might have. Children may also become withdrawn after sexual victimization.

Your child is using an on-line account belonging to someone else.

en if you don't subscribe to an on-line service or Internet service, your child may meet an offender while on-line at a friend's house or the library. Most computers come preloaded with on-line and/or Internet software. Computer-sex offenders will sometimes provide potential victims with a computer account for communications with them.

What Should You Do If You Suspect Your Child Is Communicating With A Sexual Predator On-line?

Consider talking openly with your child about your suspicions. Tell them about the dangers of computer-sex offenders.

Review what is on your child's computer. If you don't know how, ask a friend, coworker, relative, or other knowledgeable person. Pornography or any kind of sexual communication can be a warning sign.

Use the Caller ID service to determine who is calling your child. Most telephone companies that offer Caller ID also offer a service that allows you to block your number from appearing on someone else's Caller ID. Telephone companies also offer an additional service feature that rejects incoming calls that you block. This rejection feature prevents computer-sex offenders or anyone else from calling your home anonymously.

Devices can be purchased that show telephone numbers that have been dialed from your home phone. Additionally, the last number called from your home phone can be retrieved provided that the telephone is equipped with a redial feature. You will also need a telephone pager to complete this retrieval.

This is done using a numeric-display pager and another phone that is on the same line as the first phone with the redial feature. Using the two phones and the pager, a call is placed from the second phone to the pager. When the paging terminal beeps for you to enter a telephone number, you press the redial button on the first (or suspect) phone. The last number called from that phone will then be displayed on the pager.

Monitor your child's access to all types of live electronic communications (i.e., chat rooms, instant messages, Internet Relay Chat, etc.), and monitor your child's e-mail. Computer-sex offenders almost always meet potential victims via chat rooms. After meeting a child on-line, they will continue to communicate electronically often via e-mail.

Should any of the following situations arise in your household, via the Internet or on-line service, you should immediately contact your local or state law enforcement agency, the FBI, and the National Center for Missing and Exploited Children:

Your child or anyone in the household has received child pornography;

Your child has been sexually solicited by someone who knows that your child is under 18 years of age;

Your child has received sexually explicit images from someone that knows your child is under the age of 18.

If one of these scenarios occurs, keep the computer turned off in order to preserve any evidence for future law enforcement use. Unless directed to do so by the law enforcement agency, you should not attempt to copy any of the images and/or text found on the computer.

What Can You Do To Minimize The Chances Of An On-line Exploiter Victimizing Your Child?

Communicate, and talk to your child about sexual victimization and potential on-line danger.

Spend time with your children on-line. Have them teach you about their favorite on-line destinations.

Keep the computer in a common room in the house, not in your child's bedroom. It is much more difficult for a computer-sex offender to communicate with a child when the computer screen is visible to a parent or another member of the household.

"Utilize parental controls..."

Utilize parental controls provided by your service provider and/or blocking software. While electronic chat can be a great place for children to make new friends and discuss various topics of interest, it is also prowled by computer-sex offenders. Use of chat rooms, in particular, should be heavily monitored. While parents should utilize these mechanisms, they should not totally rely on them.

Always maintain access to your child's on-line account and randomly check his/her e-mail. Be aware that your child could be contacted through the U.S. Mail. Be up front with your child about your access and reasons why.

Teach your child the responsible use of the resources on-line. There is much more to the on-line experience than chat rooms.

Find out what computer safeguards are utilized by your child's school, the public library, and at the homes of your child's friends. These are all places, outside your normal supervision, where your child could encounter an on-line predator.

Understand, even if your child was a willing participant in any form of sexual exploitation, that he/she is not at fault and is the victim. The offender always bears the complete responsibility for his or her actions.

instruct your children:

to never arrange a face-to-face meeting with someone they met on- line;

to never upload (post) pictures of themselves onto the Internet or on-line service to people they do not personally know;

to never give out identifying information such as their name, home address, school name, or telephone number;

to never download pictures from an unknown source, as there is a good chance there could be sexually explicit images;

to never respond to messages or bulletin board postings that are suggestive, obscene, belligerent, or harassing;

that whatever they are told on-line may or may not be true.

Frequently Asked Questions:

My child has received an e-mail advertising for a pornographic website, what should I do?

Generally, advertising for an adult, pornographic website that is sent to an e-mail address does not violate federal law or the current laws of most states. In some states it may be a violation of law if the sender knows the recipient is under the age of 18. Such advertising can be reported to your service provider and, if known, the service provider of the originator. It can also be reported to your state and federal legislators, so they can be made aware of the extent of the problem.

Is any service safer than the others?

Sex offenders have contacted children via most of the major on-line services and the Internet. The most important factors in keeping your child safe on-line are the utilization of appropriate blocking software and/or parental controls, along with open, honest discussions with your child, monitoring his/her on-line activity, and following the tips in this pamphlet.

Should I just forbid my child from going on-line?

There are dangers in every part of our society. By educating your children to these dangers and taking appropriate steps to protect them, they can benefit from the wealth of information now available on-line.

Helpful Definitions:

Internet - An immense, global network that connects computers via telephone lines and/or fiber networks to storehouses of electronic information. With only a computer, a modem, a telephone line and a service provider, people from all over the world can communicate and share information with little more than a few keystrokes.

Bulletin Board Systems (BBSs) - Electronic networks of computers that are connected by a central computer setup and operated by a system administrator or operator and are distinguishable from the Internet by their "dial-up" accessibility. BBS users link their individual computers to the central BBS computer by a modem which allows them to post messages, read messages left by others, trade information, or hold direct conversations. Access to a BBS can, and often is, privileged and limited to those users who have access privileges granted by the systems operator.

line Service (COS) - Examples of COSs are America Online, Prodigy, CompuServe and Microsoft Network, which provide access to their service for a fee. COSs generally offer limited access to the Internet as part of their total service package.\

Internet Service Provider (ISP) - Examples of ISPs are Erols, Concentric and Netcom. These services offer direct, full access to the Internet at a flat, monthly rate and often provide electronic-mail service for their customers. ISPs often provide space on their servers for their customers to maintain World Wide Web (WWW) sites. Not all ISPs are commercial enterprises. Educational, governmental and nonprofit organizations also provide Internet access to their members.

Public Chat Rooms - Created, maintained, listed and monitored by the COS and other public domain systems such as Internet Relay Chat. A number of customers can be in the public chat rooms at any given time, which are monitored for illegal activity and even appropriate language by systems operators (SYSOP). Some public chat rooms are monitored more frequently than others, depending on the COS and the type of chat room. Violators can be reported to the administrators of the system (at America On-line they are referred to as terms of service [TOS]) which can revoke user privileges. The public chat rooms usually cover a broad range of topics such as entertainment, sports, game rooms, children only, etc.

Electronic Mail (E-Mail) - A function of BBSs, COSs and ISPs which provides for the transmission of messages and files between computers over a communications network similar to mailing a letter via the postal service. E-mail is stored on a server, where it will remain until the addressee retrieves it. Anonymity can be maintained by the sender by predetermining what the receiver will see as the "from" address. Another way to conceal one's identity is to use an "anonymous remailer," which is a service that allows the user to send an e-mail message repackaged under the remailer's own header, stripping off the originator's name completely.

Chat - Real-time text conversation between users in a chat room with no expectation of privacy. All chat conversation is accessible by all individuals in the chat room while the conversation is taking place.

Instant Messages - Private, real-time text conversation between two users in a chat room.

Internet Relay Chat (IRC) - Real-time text conversation similar to public and/or private chat rooms on COS.

Usenet (Newsgroups) - Like a giant, cork bulletin board where users post messages and information. Each posting is like an open letter and is capable of having attachments, such as graphic image files (GIFs). Anyone accessing the newsgroup can read the postings, take copies of posted items, or post responses. Each newsgroup can hold thousands of postings. Currently, there are over 29,000 public newsgroups and that number is growing daily. Newsgroups are both public and/or private. There is no listing of private newsgroups. A user of private newsgroups has to be invited into the newsgroup and be provided with the newsgroup's address

by Carrie Mulford, Ph.D., and Peggy C. Giordano, Ph.D.

Excerpts from NIJ Journal No. 261, October 2008

For 1 in 10 teens, abuse is a very real part of dating relationships.

Aproximately 10 percent of adolescents nationwide reported being the victim of physical violence at the hands of a romantic partner during the previous year. Between two and three in 10 reported being verbally or psychologically abused in the previous year. In South Carolina, for example, nearly 8 percent of adolescents reported being physically violent to a romantic partner. Interestingly, the rates of reported victimization versus perpetration in the state were similar for boys and girls.

Studies found that girls and boys perpetrate the same frequency of physical aggression in romantic relationships. This finding was at odds with what practitioners...said they encounter in their professional experience. Most of the practitioners in attendance said that they primarily see female victims.

So what is the reality? The complex nature of this phenomenon is not fully understood. Those in the field have to rely on an adult framework to examine the problem of teen dating violence.

However, we (the authors) find that this adult framework does not take into account key differences between adolescent and adult romantic relationships. And so, to help further the discussion, we offer in this article a gender-based analysis of teen dating violence with a developmental perspective

Victims and Perpetrators: What the Research Says

In 2001-2005, Peggy Giordano and her colleagues at Bowling Green State University interviewed more than 1,300 seventh, ninth and 11th graders in Toledo, Ohio. More than half of the girls in physically aggressive relationships said both they and their dating partner committed aggressive acts during the relationship. About a third of the girls said they were the sole perpetrators, and 13 percent reported that they were the sole victims. Almost half of the boys in physically aggressive relationships reported mutual aggression, nearly half reported they were the sole victim, and 6 percent reported that they were the sole perpetrator.

<span style="color: #351c75; font-family: "Trebuchet MS", sans-serif;">Editor's note: Do you think the boys lied?

Who Perpetrates Teen Dating Violence?

Studies find there is mutual physical aggression by girls and boys in romantic relationships. However, when it comes to motivations for using violence and the consequences of being a victim of teen dating violence, the differences between the sexes are pronounced. Girls also commonly report self-defense as a motivating factor, and boys commonly cite the need to exert control. Boys are also more likely to react with laughter when their partner is physically aggressive. Girls experiencing teen dating violence are more likely than boys to suffer long-term negative behavioral and health consequences, including suicide attempts, depression, cigarette smoking and marijuana use.

<span style="color: #351c75; font-family: "Trebuchet MS", sans-serif;">Editor's note: One would not think self defense would constitute violence, but violence is violence presumably...

Applying Adult Perspectives to Teen Dating Violence

Why do teenagers commit violence against each other in romantic relationships? Practitioners and researchers in the field tend to apply an adult intimate partner violence framework when examining the problem of teen dating violence.

A split currently exists, however, among experts in the adult intimate partner violence arena.

Some experts hold that men and women are mutually combative and that this behavior should be seen as part of a larger pattern of family conflict.

Another group of experts holds that men generally perpetrate serious intimate partner violence against women. They contend that men in patriarchal societies use violence to exert and maintain power and control over women.

We believe, however, that applying either of these adult perspectives to adolescents is problematic. Although both views of adult intimate partner violence can help inform our understanding of teen dating violence, it is important to consider how adolescent romantic relationships differ from adult romantic relationships in several key areas.

How Teen Dating Violence Differs: Equal Power

One difference between adolescent and adult relationships is the absence of elements traditionally associated with greater male power in adult relationships. Adolescent girls are not typically dependent on romantic partners for financial stability, and they are less likely to have children to provide for and protect.

It is interesting to note that adults who perpetrate violence against family members often see themselves as powerless in their relationships. This dynamic has yet to be adequately explored among teen dating partners.

Lack of Relationship Experience

A second key factor that distinguishes violence in adult relationships from violence in adolescent relationships is the lack of experience teens have in negotiating romantic relationships. Inexperience in communicating and relating to a romantic partner may lead to the use of poor coping strategies, including verbal and physical aggression. A teen who has difficulty expressing himself or herself may turn to aggressive behaviors (sometimes in play) to show affection, frustration or jealousy.

As adolescents develop into young adults, they become more realistic and less idealistic about romantic relationships. They have a greater capacity for closeness and intimacy. Holding idealistic beliefs about romantic relationships can lead to disillusionment and ineffective coping mechanisms when conflict emerges. It also seems reasonable to expect that physical aggression may be more common when adolescents have not fully developed their capacity for intimacy, including their ability to communicate.

The Influence of Peers

We would be remiss to try to understand teen behavior and not consider the profound influence of friends. Peers exert more influence on each other during their adolescent years than at any other time.

Not only are friends more influential in adolescence than in adulthood, but they are also more likely to be "on the scene" and a key element in a couple's social life. In fact, roughly half of adolescent dating violence occurs when a third party is present. Relationship dynamics often play out in a very public way because teens spend a large portion of their time in school and in groups. For various reasons, a boyfriend or girlfriend may act very differently when in the presence of peers, a behavior viewed by adolescents as characteristic of an unhealthy relationship. For example, boys in one focus group study said that if a girl hit them in front of their friends, they would need to hit her back to "save face.

Conflict over how much time is spent with each other versus with friends, jealousies stemming from too much time spent with a friend of the opposite sex, and new romantic possibilities are all part of the social fabric of adolescence. Although "normal" from a developmental perspective, navigating such issues can cause conflict and, for some adolescents, lead to aggressive responses and problematic coping strategies, such as stalking, psychological or verbal abuse, and efforts to gain control.

<span style="color: #351c75; font-family: "Trebuchet MS", sans-serif;">Editors note: It looks like a adults act like they are kids!

Where Do We Go From Here?

Adult relationships differ substantially from adolescent dating in their power dynamics, social skill development and peer influence. These factors are critical to understanding physical violence and psychological abuse in early romantic relationships and may help explain the similar perpetration rates among boys and girls suggested by current statistics.

All of this points to important implications for teen dating violence prevention and intervention strategies. Because girls engage in high levels of physical aggression and psychological abuse and most abusive relationships are characterized by mutual aggression, prevention efforts must be directed toward both males and females, and interventions for victims should include services and programming for boys and girls. Interventions must also distinguish between severe forms of violence that produce injury and fear and other more common abuse.

And finally, research on the extent to which teens involved in abusive relationships become involved in adult abusive relationships — whether as victims or perpetrators — is sorely needed.
According to charges filed by the Las Cruces police, Gonzales, 35, was saying good by to a 14 year old girl February 14th in the 5800 block of Stern Drive. Mom and dad were out of the house at the time. Gonzalez apparently stayed a little late and he was spotted by the girl's parents as he left the child's house, according to allegations.

Apparently, after questioning, the truth, according to Hoyle and someone else, started coming out. It is not clear who talked, Earnest B. Gonzales or the child, or whether it all a matter of speculation. No matter who spilled the beans, the girl allegedly had been having sex with Ernesto since she was 12 years old!

The Las Cruces Sun-News reported after picking the story up from a police department press release.

The investigation is on-going. That is a nice way of saying, if you have information on this sick relationship you should come forward.

If you know anything about a relationship between a little girl who lives in the 5800 block of Stern Drive and Earnest B. <span style="font-family: "Trebuchet MS", sans-serif;">It all came to an end on October On October 21, 2008, when the cops broke down Corey's door. Dewey Nelson likes 'em young. Well maybe he is not after our five and six year olds. He is just as dangerous, preying upon 15 year olds.

Dewey met his demise after meeting a girl on Myspace. Apparently the two had on-line sex and decided they just had to meet in person. The Jolly Rancha rented a car and drove from Hillsville, Va. to Livingston Texas to pick his little pretty up.

The two returned to Dewey's apartment in Hillsville where the run-away stayed with Dewey for two weeks. During her vacation in Dewey's apartment the child engaged in sexual intercourse with senor Nelson and also had oral sex, according to testimony.

"He thought oral sex was having sex on the telephone"
Dewey later said of his confession, he thought oral sex was having sex on the telephone. Likely, his statement was an effort to avoid confessions he made to police, but dumber people have been born. Perhaps he was serious.

Somewhere towards the end of the two week love affair Dewey had one of those, boy-am-I-in-trouble moments. He said he discovered the new girl in his life was not 19 as he claimed she said she was. She was 15! It is just as likely the two had a fight and Dewey wanted to get rid of the problem he had caused for himself. No information suggests this, but it may have happened that way. No matter the motive, what does a 39 year old do when he decides to return the child he has been molesting to her parents?

"Dewey played innocent after stealing the innocence of a young girl"

The truth, or a version of the truth, is usually the best way. The family was notified, Dewey played innocent after stealing the innocence of a young girl. Mom came to Hillsvalle to take her daughter home and end the relationship with this strange man.

Child molesters are not always the brightest people. Dewey continued his relationship with the 15 year old. One would think, after having dodged a bullet, Dewey Nelson would have avoided the child like the plague. He should have been charged after his two week jaunt and was not. Best to let well enough alone. Not Dewey.

Nelson eventually convinced the 15 year old running away from home is what young people do. He again rented a car and headed out onto the road to pick the girl up again. What was in the 39 year old's mind as he raced across country to Augusta, Kansas, where the family had moved? Dewey picked the youth up and they were soon back in Dewey's apartment in Hillsvalle.

"The young looking girl living with him was his 13 year old daughter, he said"

Of course, the child was reported missing. One of the first places to look was the strange guy who had taken the girl earlier in the year. Nelson was prepared for that. He had a false ID made for the young girl which he presented to police when they came knocking on the door. The young looking girl living with him was his 13 year old daughter, he said. He must have figured, if they would buy the phone sex is what is meant by oral sex, then the police would be duped by a fake I.D. It didn't take long to determine the ID was a fake. Dewey got the silver bracelets and the wayward youth got a free trip home.

Dewey pled guilty last November to two federal charges of traveling across state lines to engage in illegal sexual activity, and two charges of transporting a child across state lines to engage in sexual activity. Dewey probably figured he was going to be convicted at trial anyway. The guilty plea would save the court time and increase Dewey's chances of a favorable sentence.

As it turns out, the girl he met on Myspace was not the first youth he had sexually abused. Dewey had been married and divorced twice. In each case, he started his relationships with his wives before they were of legal age. He got one of his wives pregnant while she was underage.

Why should we be surprised. Dewey was also sexually abused when he was 7, a thread many child sexual abusers have in common. Someone stole their youth and having learned the lesson well, they return the favor. The chain of sexual abuse continues through the generations.

"The judge said society required additional protection"

When sentencing day rolled around the Judge gave Dewey a few more years than the minimum so he could contemplate his actions while living with other dangerous criminals. U.S. District Judge Glen Conrad said he was sentencing Nelson above the mandatory minimum of 10 years because society required additional protection.

Dewey got lucky. Extra protection for society turns out to be 3 years. It could have been a lot worse.

"You're not the only one who has had adverse circumstances to deal with ... you just didn't react well," Conrad told Nelson. "You committed questionable acts across your adult life"

A statement from the prosecuting attorney:

“Sexual predators like Dewey Nelson target the most vulnerable among us—our children,” United States Attorney Timothy J. Heaphy said today. “Mr. Nelson enticed a minor child to travel halfway across the country so that he could fulfill his deviant sexual desire. His subsequent attempts to cover up his crime failed, and he was brought to justice by the dedicated law enforcement team who conducted this investigation. This case shows that investigators are watching, monitoring, and moving swiftly to apprehend the criminals who lurk on the internet and target children. These cases are a priority for the United States Attorney’s Office, and we will continue to seek justice for the victims of these terrible crimes.”

Project Safe Childhood was involved in the apprehension and arrest of Dewey Nelson. The project combats child sexual exploitation and child abuse. It was launched in May 2006 by the Department of Justice and is Led by the United States Attorneys’ Offices and the Criminal Division's Child Exploitation and Obscenity Section (CEOS).

Dewey Nelson faced charges of traveling across state lines to engage in illegal sexual activity, and two charges of transporting a child across state lines to engage in sexual activity as a result of the hard work of Project Safe Childhood. Judge Glen Conrad let Dewey Nelson off easy. I suspect United States Attorney Timothy J. Heaphy would have preferred a longer term of "protection" for the the public. Miguel Rugerio better be a tough cat. Young men who go to prision have to be. In general, they have two choices: Fight, or become a bitch. I don't think I have to tell you what being a bitch means in an all male prison.

He sure knows how to treat young ladies like one. Miguel was convicted today of recruiting and transporting young lantina girls to come to the U.S. on promise of a job with benefits. In some cases, Miguel lured empovrished women on promise of marriage. Once the bride-to-be arrived in the U.S. she had an unpleasant surprise.

Unfortunately, there was a bit of a communication gap between what the Mexican girls had in mind for work, and what Miguel had in mind. The Mexican youths thought they were going to the U.S. to live the Amercian dream. Even the poorest home in the U.S. can look like a palace to some impovrished Mexians. The girls thought there would be a chance at a job, a chance to save money, to send it home to help out the family and a chance to start a family of thier own. The girls were freed in 2009.

"He put the girl to work pleasuring men in exchange for money"

Miguel had a different plan. He put the girl to work pleasuring men in exchange for money. In fact, the mamasita was forced to pleasure lots of men, several each night. Seven nights per week. No time off for good behavior. Miguel and his buddies kept the money.
“Human traffickers trick, lie and coerce young women into this country with the promise that they will have their freedom, and work a legitimate job," said acting U.S. Attorney Sally Quillian Yates. Read more about the original plea

Meanwhile, instead of living in an upwardly mobile household, the girls were forced to live with others in "Repulsive living conditions" according to Sally Quillian Yates, Acting United States Attorney.

There were at least 5 girls who fell for Miguel of Miguel Rugerio's promises.

"The sentence is gratifying given the horrible conditions the victims were forced to endure"

“Few crimes are more repugnant than sex trafficking helpless and innocent victims,” said Kenneth Smith, Special Agent in Charge of the U.S. Immigration and Customs (ICE) Enforcement Office of Investigations in Atlanta. “This sentencing is gratifying given the horrible conditions the victims in this case were forced to endure."

According to the FBI press release, Rugrerio admitted in his plea that from July 2006 to August 2008, he conspired with others to use force, fraud and coercion to cause approximately five female victims to come to the Atlanta area from Mexico and to engage in prostitution for the financial benefit of the members of the alleged conspiracy.
The soon to be jail bird used false promises of better lives and to lure young, impoverished Mexican women to come to the United States, knowing that he would cause the victims to engage in prostitution upon their arrival. Rugerio forced his victims to engage in commercial sex with many men per night, seven days a week.

Rugerio, 28, a Mexican national, was sentenced to federal prison today by United States District Judge Clarence Cooper on charges of conspiracy to commit sex trafficking and related immigration offenses, and of transporting one of the victims of the conspiracy, a young Mexican woman identified as “N.M.,” in interstate and foreign commerce for purposes of prostitution.
We advocate fair immigration laws for those who are willing to come to the US and work towards a better life. Such immigration policy should include a practical way for those seeking jobs to cross the border. It should include a way for those who are alrady here to stay here. It should provide a way for the children of undocumented workers the chance to go to school and improve themselves.

<span style="color: #cc0000; font-family: Georgia, "Times New Roman", serif; font-size: large;"> "Aggressive investigation and prosecution will go a long ways"
One thing our dream does not include is luring innocent women across the border on promise of good paying jobs and a better way of life when the real plan is to enslave the young ladies in a sex business. Rational reform will solve a lot of these problems. Aggressive investigation and prosecution will go a long ways, as well. Sally Quillian Yates and Charysse L. a BIG HIT!

More than 8,500 wealthy Americans took a few minutes to give something back when they attended the 2010 North American International Auto Show's Charity Preview. As a result, Detroit will have $2 million more to spend on at-risk kids!

There was much more support for the show this year as ticket sales were up by 25%! The show is a black tie affair, attracting some of the hoop-la in New York City.

Chairman Doug Fox said:
"Tonight's event isn't just about the glitz and glamour of the attendees or the cars; it's about the thousands of children that need our help. And the generosity of all Charity Preview attendees is helping create unlimited potential for these kids, who are in fact our future."

Part of the draw for those who supported the show this year was the rock band the Romantics, with their up-beat tunes that appeal to several generations.

"We had a great band performing in the Romantics, but we had an equally great group of sponsors coming together to make music to the ears of thousands of local kids," Fox noted.
On January 13, 1996, Amber Hagerman was abducted while riding her bicycle near her house. She was subsequently brutally murdered. It was speculated if an emergency system to locate abducted children had been in place, perhaps this tragic death might have been prevented.

<span style="font-family: "Trebuchet MS", sans-serif;">After a law enforcement agency determines a child has been abducted and is in imminent danger, the Amber Alert is put out. The broadcasts include information about the child and abductor that could lead to the apprehension of the abductor and the return of the child to his or her parents. Details including the physical description of a suspect vehicle, a picture of the missing child and other information is broadcast.

<span style="font-family: "Trebuchet MS", sans-serif;">The AMBER Alert program began in 1996 when Dallas-Fort Worth broadcasters teamed up with local police to develop an early warning system to help find abducted children.
<span style="font-family: "Trebuchet MS", sans-serif;">The amber alert broadcast program has been so successful it has been extended to a few of the tribal nations. <span style="font-family: "Trebuchet MS", sans-serif;">Kim Lowry, who is the communications director for the Office of Justice Programs wrote the following post regarding the program that saves lives.

<span style="font-family: "Trebuchet MS", sans-serif; font-size: large;">Tell us Kim!

A message from Kim Lowry, Department of Justice:

There are few things more frightening than the loss of a child. Each year some 800,000 children are reported missing in the United States. Most of these children are not victims of abduction, and, fortunately, most soon return home.

For some, however, their separation will last far longer—even a lifetime. For others, their abduction ends in the most tragic of ways.

The challenges of rescuing endangered missing and abducted children require a determined and coordinated effort. The first hours following a child’s abduction are the most critical. Of the children murdered in stranger abductions, 3 out of 4 are killed within the first three hours.

"Early intervention is crucial"

Early intervention is crucial and provides our best hope of protecting such children and reuniting them with their families. It was for this reason that the AMBER Alert system was initiated 14 years ago today.

Following the 2002 White House Conference on Missing, Exploited, and Runaway Children, the PROTECT Act placed the AMBER Alert program under the auspices of the Department of Justice’s Office of Justice Programs, with its Assistant Attorney General serving as AMBER Alert’s National Coordinator.

As a national effort, the program coordinates media, law enforcement, and transportation agencies’ efforts to notify the public about missing children in the critical first hours following their abduction.

"every state, two U.S. territories, and the District of Columbia have AMBER Alert plans"

I am pleased to report that every state, two U.S. territories, and the District of Columbia have AMBER Alert plans, and we are working hard to extend the program’s outreach.

Scores of tribal communities are developing their own AMBER Alert plans and programs and we have worked closely with Canada and Mexico to expand AMBER Alert efforts across our nation’s northern and southern borders.

The Department of Justice is committed to protecting our children and their families. Thanks to the collaboration of AMBER Alert’s partners and the timely response of concerned citizens to its alerts, 495 children have been returned to their families and homes.

AMBER Alerts are of course only a piece of what the Department of Justice does to protect children. Today, the Department announced the appointment of Francey Hakes to serve as the National Coordinator for Child Exploitation Prevention and Interdiction, a position created by Congress in the Protect Our Children Act of 2008.

I invite you to visit the AMBER Alert Web site to learn how you can help.

<span style="font-family: "Trebuchet MS", sans-serif; font-size: large;">Thanks, Kim!

~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~<span style="font-family: "Trebuchet MS", sans-serif;">Here are some Amber Alert success stories!
<span style="font-family: "Trebuchet MS", sans-serif;">The Amber Alert program is growing and expanding. There is now the Secondary Amber Alert program, a program developed by the DOJ.
<span style="font-family: "Trebuchet MS", sans-serif;">The National Center for Missing & Exploited Children (NCMEC), which is directed by the <span style="font-family: "Trebuchet MS", sans-serif;">U.S. Department of Justice, which coordinates the AMBER Alert on a <span style="font-family: "Trebuchet MS", sans-serif;">national level, is developing the AMBER Alert Secondary Distribution S<span style="font-family: "Trebuchet MS", sans-serif;">ystem. This system was designed to expand AMBER Alert activations for local police and state <span style="font-family: "Trebuchet MS", sans-serif;">law enforcement.
<span style="font-family: "Trebuchet MS", sans-serif;">Law enforcement agencies now can use many additional methods to alert citizens. First, the <span style="font-family: "Trebuchet MS", sans-serif;">NCMEC is notified. The NCMEC then sends the Alert to all <span style="font-family: "Trebuchet MS", sans-serif;">NCMEC approved Secondary Distributors. This allows law enforcement more time to concentrate on investigating the case.
There are many secondary distributors. They include any authorized wireless carrier, content providers, and major retailers. To qualify as a distributor of the Amber Alert, the secondary distributor must have the capability to distribute AMBER Alert <span style="font-family: "Trebuchet MS", sans-serif;">messages to a geographically targeted area at the request of law enforcement.
<span style="font-family: "Trebuchet MS", sans-serif;">Secondary methods of distribution assist in the overall goal of <span style="font-family: "Trebuchet MS", sans-serif;">the AMBER Alert program – to immediately notify as many people as possible about <span style="font-family: "Trebuchet MS", sans-serif;">recent child abductions, and provide them with information that can help in the search for <span style="font-family: "Trebuchet MS", sans-serif;">the abducted child, suspected abductor, or suspected vehicle.
He has been fighting the child pornography charges since then.
The jurors were waiting to be empanelled. Opening statements would soon follow. In a surprise move, Rex Randall decided to take a plea.
Rex Randall Smith admitted to United States District Judge W. Keith Watkins of his filming the sexual abuse of children he was caring for including a 3 year old girl. Rex Randall Smith was in Longview Texas in May of 2000 when most of the filming occurred. The pedophile also admitted to transporting videotapes into Dale County, Alabama in 2005, which is where the truck and trailer were when the child porn was discovered. , U.S. Attorney Leura G.
"Smith brought the videotapes across state lines"
A subsequent plea hearing was held today in front of Federal Magistrate Judge Susan R. Walker, Title 18, United States Code, Section 2251(a) makes it a crime for any person to employ, use, persuade, induce, entice, or coerce an individual who has not attained the age of 18 to engage in sexually explicit conduct for the purpose of producing a visual depiction of that conduct. The crime in this case was completed when Smith brought the videotapes across state lines, thereby invoking federal jurisdiction.
This was not Rex Randall Smith’s first time around on child pornography charges. When he was 23 he was convicted for sodomy of a child under 14. He had been a fugitive from justice for nearly 18 years. The man who steals the youth of innocent children used a variety of aliases to keep out of the clutches of the law. He kept on the move and lived in multiple states, including Missouri, Arkansas, Tennessee, Oklahoma, Wyoming, Montana, Colorado, California, Texas and Alabama. It was in Louisiana where he finally met the law once again.
"a variety of law enforcement efforts were involved"
As is typical in child pornography cases, a variety of law enforcement efforts were involved, including agents from the FBI, Ozark Police Department and the Hartford Police Department. The 55 year old is being prosecuted by Assistant United States Attorneys Nathan D. Stump and Brandon K. Essig.
Project Safe Childhood, which is led by United States Attorneys’ Offices, joins federal, state and local resources to bring child molesters who exploit children individuals who exploit children via the Internet to justice.
Ricky Randall Rex Smith will have a long time to think about the lives he has ruined. The minimum sentence for producing child pornography is 15 years. Because he has a prior conviction he may get life under the ‘two strikes and you are out’ law, Title 18, United States Code, Section 3559(e). Likely the plea made today was done so on the chance the judge will be lenient.
Frederick McLean Still Free
Frederick McLean is a Jehovas Witness. He also is a master at manipulating little children using gods word, if the allegations abut him are true. Authorities allege the 58 year old is facing charges of sexual assault on a child. One of his victims said the brute assaulted her more than 100 times starting when she was five years old. Many of the victims were met and manipulated through the Jehovah’s Witness.
McLean is no dummy. Authorities believe he knew charges would soon be brought against him. He prepared himself to go on the run, including selling a favorite truck and liquidating other assets. He admitted to family members what he had done before heading out.
Authorities are concerned McLean may be dangerous and should not be approached. They say he may even be suicidal. When a person is willing to take their own life they are often willing to take the lives of those around them.
McLean is white, weighs in at 170 pounds, measures 5 feet, 11 inches, and has hazel eyes and graying brown. He is an auto mechanic and once restored race cars from the 1960s and '70s. McLean is also an experienced outdoorsman who might be spotted at camping areas.
In fact he was so infatuated with her he traveled from Chino Hills, California to Western Michigan in order to have his way with her. Woods had a problem, however. His new girl friend was only 15 years old and he knew it. That makes Woods a pedophile.
Child molesters have their own society. After all, they can't have a relationship in the normal fashion. Imagine what mom and dad would say when their 15 year old daughter introduces them to her new 31 year old boyfriend. If it happened in the wrong part of the country dad would chase the fool down the drive way with his shotgun at the ready. In other situations, the predator gets free room and board in the state pen.
Instead of meeting the folks, Woods set up camp in a motel. He then picked up his new girlfriend from school each day and took her to his motel room for fun and games. He quickly returned her before classes let out so the folks back home would not get wise. Meanwhile, the parents thought their child was in school and out of the reach of predators.
"He faces 10 years to life"
Woods was arrested and pled innocent to the charges. However, on January 06, 2010, Woods changed his plea and will shortly stand before the court for sentencing. He faces 10 years to life, depending upon the mood of the judge and the mitigating circumstances if there are any. Assuming Woods walks free again, he will have to register as a sex offender and undergo supervised probation.
Assistant U.S. Attorney Nils R. Kessler prosecuted the child moleter. Having sex with minors, even if they are a few years short of the age of consent, will be dealt with sternly. Robbing a child of her innocence, even if the child is an active and willing participant, is an unforgivable crime.
Police officer guilty of child pornography
Officer David Courtney Childers, Horny County
Not even police officers get away with possessing images of children having sex. David Courtney Childeers, a Horny County police officer, pled guilty to possession of child pornography. He is awaiting sentencing.
The FBI went into action against a guy who likes to share his collection of kiddy porn after a June 2008, undercover operation revealed him as a suspect. Childers and other perpetrators used peer to peer sharing to trade their dirty little secrets.
Peer to peer sharing, or p2p, is the practice of distributing or providing access to digitally stored information, songs and pictures, from one computer user to another without necessarily posting it on the net for all to see. Popular file sharing programs include gnutella http://wiki.limewire.org/index.php?title=GDF, gnutella2 or g2 http://g2.trillinux.org/index.php?title=Main_Page, emulehttp://download.cnet.com/eMule/3000-2196_4-10225243.html?tag=mncol;lst, Kaza http://www.kazaa.com/and Bit Torrent http://www.bittorrent.com/btusers/what-is-bittorrent
Peer to peer file sharing may be implemented in a variety of storage, transmission, and distribution models. Common methods are manual sharing using removable media, centralized computer file server installations on computer networks, World Wide Web-based hyperlinked documents, and the use of distributed peer-to-peer (P2P) networking.
"P2P sharing is perfectly legal"
P2p sahring is perfectly legal. However, it has been frequently used for illegal means. One of the most famous cases was Napster, sharing music for free which was subject to copyright. Child porn users have been p2p of late in order to trade their fare with less risk of getting caught.
"Contact was made with a suspected perp who was offering to share his collection of child porn"
Illinois FBI agents went undercover using the identification of a known and trusted child pornographer. Contact was made with a suspected perp who was offering to share his collection of child porn. Agents downloaded the child pornography, and traced the communication back to officer Childers.
Shortly thereafter the officers had officer Childers in custody along with his computer. A brief search of the computer memory revealed the kiddy porn. It was also quickly determined that Childers was a member of law enforcement and employed as a police officer with Horry County.
The office of United States Attorney Kevin F. McDonald issued a press release stating that they got one of the bad guys. Childers pled guilty in federal court to possession of child pornography, a violation of Title 18, United States Code, Section 2252A(a)(5)(B). Assistant United States Attorney William E. Day, II, of the Florence office handled the case.
United States District Judge R. Bryan Harwell accepted the plea and will sentence Childers at a later date. The maximum penalty Childers can receive is a fine of $250,000.00 and imprisonment for 10 years. Possession of child pornography and trading it on the net, even with a degree of privacy, is illegal. Those fighting the exploitation of a minor and kiddy porn have won another round.Unknownnoreply@blogger.com0tag:blogger.com,1999:blog-6136519541714533128.post-72360248384040697782010-01-12T16:09:00.000-08:002010-01-12T16:09:01.720-08:00Two girls rescued from child porn fiend
Six year old child sexually molested
Rescuers find two children,
using a beer can a glasses
Cross border cooperation puts bad guys away
Law enforcement from two countries worked together to put a child molestor where he can't hurt widdle gurls anymore. Canadian authorities spotted pictures of a six year old girl having sex with an adult male. Since the kiddy porn pics were new, the authorities were optimistic they could catch the pedophile. Fresh pictures means fresh leads and a new child in danger from child porographers.
The Royal Canadian Mounted Police found the child porn images and sent them to the Toronto Police Services. After analysis, a blurry beer can from a rare manufacturer was seen. The beer is only made in the Northeastern U.S. This information was sent to the National Center for Missing and Exploited Children, also known as NCMEC.
At the same time, investigators from the Bellfast, Maine Police department and the State Police from Maine discovered the images. After analyzing the dirty pictures they discovered the child in the pornographic photo wore eyeglasses. This information was sent to the NCMEC. Law enforcement from the U.S. and Canada began a cooperative effort to find the little girl.
The Beer can and eye glasses helped narrow down the location of the perpetrator. The manufacturer of the beer said their special brew was distributed in six states only, including New York and Maryland. The manufacturer and model number of the glasses were quickly identified.
After these encouraging leads, a team of very dedicated investigators started in on the pain staking foot work required to track down a man who did evil things including having sex, with children. On August 1, 2008, a special agent from the New York using the Innocent Images National Initiative Program opened the case and began canvassing ophthalmologist in the six state region where the beer was distributed.
Bingo! After three weeks of hard work an eye doctor in Maryland recognized the child and called FBI agent Michael Sabric in the FBI New York Office. As it turned out the child had been in the doctor's office that very day! It was her first day of school.
Sabric organized a surveillance team and they set up on the house where the girl lived. When she came home from school the agents were able to identify her from her photo as the victim. At that point a search warrant was easy to get.
Special Agent Rachel Corn from the Baltimore Cyber Squad met with a judge and obtained the warrant. At 10:00 p.m. the police were knocking on the door of a man who steals the youth from children. The Cyber team assembled a forensic child interviewer, a victim assistance representative the evidence response team and together they made the bust.
It didn’t take long to get to the bottom of the matter. The child identified two perpetrators and both men were arrested. In October, one of the men involved was sentenced to 45 years in prison for sexually exploiting a minor and producing child pornography. His accomplice had already received a 36-year sentence.
In the old days one branch of law enforcement didn’t know what the other was doing. Today, not only is U.S. law enforcement cooperating, but law enforcement on both sides of the border work together to put those who exploit children down for good.
Not every child abduction and pornography case ends with rescued children. In this case, two children were found to be victims, the 6 year old and her sister. The investigators who worked hard to stop kiddy porn, child abuse, and sexual exploitation of a minor were relieved to bring suffering victims of child pornography to safety.
